I don't know about the text, but CNN's calling it for Biden.  Which makes sense given that the other likely choices have been ruled out.

ABC News reported that the Secret Service arrived at his residence. Not only was there Press, but normal citizens just hanging out around his place, hoping to break the news.

And hooooooollly shit, his eldest son is shipping off to Iraq around election time. His eldest son is not only a captain in the Army National Guard, but also the state's Attorney General. If Biden wins both the Vice-Presidency, and his Senate seat, he could retire the seat, and the Democratic Governor would then appoint a replacement. The presumptive replacement? Biden's eldest son. Vhat a tweest!

I've probably told this story before, but I knew a guy in college who was once talking about how the assault weapons ban was unconstitutional.  When I said that ordinary citizens don't need assault weapons, he responded that the Bill of Rights isn't based on need.

It has bugged me for YEARS that I was drunk and slow and did not respond with "Recite the Second Amendment.  Right now."

Of course, now we've got a Supreme Court who agrees with my friend that the first half of the Second Amendment is just window-dressing and doesn't mean anything, so I guess I lose out on that one.

Wait, what?  The first part isn't window dressing, it's a qualifier.  Because the state needs to be armed to protect itself, citizens must retain the right to arm themselves to protect themselves from the state.  They did just get done with this whole war for independence.  It certainly is debatable as to how useful such a clause is in this modern world, but the intent is fairly clear.

I agree.

The self-described Constitutional constructionists on the Supreme Court don't.

Or at least, to put it less glibly, they have a pretty fucking broad definition of what constitutes a well-regulated militia.

Anyway.  I think armed rebellion against the government is something of an anachronistic concept, but on the other hand I'm confident that if Jefferson were alive today he'd be calling for it.

I think what Thad's saying is that the Second Amendment says right there in the wording that the right to bear arms cannot either be taken away or unregulated.

Letting citizens with no need have assault weapons is pretty unregulated.  Thus, unconstitutional.

Of course it's hard to tell, the document itself being written in a form of English nobody has spoken in nearly 300 years, but that's never stopped anybody from trying to parse it literally before.
